A man accused in the armed robbery and aggravated assault in themidday shooting of an elderly Brookhaven woman will wait anothertwo months for his omnibus hearing on a previous charge of armedrobbery after being assigned a public defender Monday in LincolnCounty Circuit Court.

David Walker, 20, of Brookhaven, who was arrested with his brotherQuincy Walker, 22, also of Brookhaven, in the April 24 robbery andshooting of 86-year-old Eva Pullen in downtown, appeared in courtMonday for a hearing after being indicted in the late October armedrobbery of a North Jackson Street convenience store.

A docket for Monday’s court session indicated David Walker was toldto return to court with a hired attorney in April. The name Boernerwas listed as the attorney for a waiver of arraignment in earlyMay; however, conflicts of interest would prevent either BradBoerner, who is municipal court prosecutor, or his law partnerfather Bill from representing Walker in the city case.

Ultimately, David Walker’s case was assigned public defender JasonTate during Monday’s court session, and his omnibus hearing wasscheduled for August 2. The main purpose of an omnibus hearing isfor the prosecutor and the defendant’s counsel to discuss pretrialmatters pertaining to the case and to schedule a trial date.

Regarding the April charges, David Walker was released last week athis preliminary hearing after a city court judge determined therewas insufficient evidence to hold him. Quincy Walker remains in astate prison, since he was out on probation from previous chargesat the time of his arrest.

District Attorney Dee Bates said he plans to present the Aprilarmed robbery and aggravate assault case to the grand jury as soonas possible.
