BROOKHAVEN — Judge David Strong ordered a continuance in the Mississippi vs. Brandon and Gregory Case trial Friday, Oct. 11. The continuance states the trial will resume at a later date agreed upon by the attorneys. 

District Attorney Brendon Adams said to his knowledge, the defense’s motion to dismiss has not been ruled upon by Strong. 

In Sept., Strong asked the defense attorneys for Brandon and Gregory Case to file a short letter brief and send a copy to the district attorney’s office in the next five days regarding the motion to dismiss. The district attorney will then have five days to file his short letter brief and send a copy to the defense attorneys. Adams said the response was filed last week. 

Strong could make a ruling on if the case will be dismissed entirely or possibly exclude new evidence submitted by Brookhaven Police Department’s detective Vincent Fernando in a retrial of the “FedEx shooting case.”

The FedEx shooting case is the nickname given to an incident which occurred nearly three years ago on Jan. 24, 2022. Father Gregory Case and son Brandon Case allegedly fired upon FedEx delivery driver D’Montario Gibson. The Cases were indicted by a Lincoln County Grand Jury on charges of attempted murder, conspiracy and shooting into a motor vehicle. 

The next likely trial terms for the case would be in Feb. 2025 or in April 2025. Again, both the district attorney and defense attorney have to meet and agree upon an appropriate date for the trial to continue.
