A man arrested last month on a murder indictment was formally arraigned Monday and remains in jail, said court officials and law enforcement.

In a Circuit Court appearance before Judge David Strong, the District Attorney’s Office read Kimbley Crimiel, 36, his indictment, said Circuit Clerk Dustin Bairfield

The indictment alleges Crimiel shot and killed Marvin Desmond Brown Jr. in May 2012 with a firearm.

Following Monday’s arraignment, Crimiel remains held in the Lincoln County Jail without bond.

The court proceedings were continued to an omnibus hearing on May 20. Public defender Jason Tate has been appointed by the court to represent Crimiel, Bairfield said.

An omnibus hearing is for the discussion of pretrial matters.

The indictment alleges Crimiel didn’t intentionally kill Brown. Rather, the indictment claims Crimiel shot “an occupied dwelling house, although without any premeditated design to effect the death of any particular individual.”

In doing so, however, the indictment describes Crimiel as “committing an act eminently dangerous to others and evincing a depraved heart, regardless of human life.”

A grand jury handed down the indictment last September, but Crimiel couldn’t be located by law enforcement until early March.
