The man charged with the murder of 31-year-old Timothy Green on Spur Lane in April waived his arraignment this week, entering a plea of not guilty.

Fred Hill III, 24, of 1515 Spur Lane, has an omnibus hearing set for Nov. 9 at 11 a.m. Hill was indicted Sept. 8 for first-degree murder, shooting into a dwelling, possession of a firearm by a felon and having a cellphone in jail.

Lincoln County Sheriff Steve Rushing said the April 2 fatal shooting likely stemmed from a dispute between Hill and Green. Green was found dead at the scene on Spur Lane when the sheriff’s department and ambulance arrived.

During a court hearing June 29 presided over by Circuit Court Judge David Strong, Hill’s council approached with a motion to reduce his bond to an amount that could be paid by the family.

Strong granted a bond reduction to $500,000 with conditions. If bond was met for Hill he would have to live in the city of Brookhaven with his family, he could not travel within a one-mile radius of where the crime was committed and he would have no contact with the victim’s family or anyone associated with the case.

Hill remains in Lincoln County Jail.

Hill’s father, Fred Hill Jr., of 108 West Highland Drive in Brookhaven, was arrested last month by the LCSO for intimidating a witness, LCSO Chief Deputy Johnny Hall Jr. said. Fred Hill Jr. was arrested around 4 p.m. Sept. 2 and released later that day.

Moncherik Hooks, 27, also had his omnibus hearing continued to Nov. 9. The motion for continuance says “counsel for Moncherik Hooks has not been able to get the discovery and will be out of town on Oct. 5.”

Court records show Hooks’ attorney will be changed from City Attorney Joseph Fernald, as it is a city case.

Hooks was arrested in early February and indicted July 15. Hooks’ indictment says “on a day between Nov. 1 and January 21, […] Hooks, a male over the age of 18, did willfully, feloniously and unlawfully touch […] a female child under the age of 16 for purposes of gratifying his lust […].”

Hooks was released April 22 on a $25,000 bond.
