Murder suspect not indicted

The man accused of a July murder in Brookhaven had charges dropped after a grand jury did not indict him in its April session.
Pierre Thomas, 23, of 829 Funches St., was arrested for the murder of Glen Mack on July 24 following the fatal shooting, which occurred the night before. Thomas was also charged with the possession of marijuana with intent to deliver and the possession of cocaine with intent to deliver.
According to court documents, the grand jury refused to indict Thomas, meaning he no longer faces the murder charge.
According to police reports, BPD responded to a call of a shooting at 11:42 p.m. on July 23. Police Chief Bobby Bell said the shooting occurred in the Cloverdale area; it was the second shooting that occurred in the Cloverdale area and the third in Brookhaven that month.
Bell said when responders arrived on the scene, they found the victim shot in the upper leg. Bell said the bullet entered the upper leg, went through and exited through the other leg. Mack was transported to King’s Daughters Medical Center and then airlifted to Jackson. Lincoln County Coroner Clay McMorris said the victim was pronounced dead at University of Mississippi Medical Center at 5 a.m. the following morning.
Lincoln County District Attorney Dee Bates said he cannot comment on the decision to not indict Thomas because he was asked to step out of the room when the 12-member jury made the decision. Bates said he is there to advise the jury, while various sources give testimonies in the case.
If additional evidence is found, the case could be re-presented to a grand jury, Bates said.
Despite not being indicted on the murder charge, Thomas remains in the Lincoln County jail on drug charges, according to Lincoln County Sheriff Steve Rushing.
Thomas is the second man accused of a 2015 murder that a grand jury refused to indict.
Claudis D. Montgomery, 40, of 4208 Highway 550, was released from the Lincoln County jail in December after a grand jury refused to indict him in its December session.
Montgomery was arrested and charged with murder on July 7 after the July 5 shooting of Kelcay Humphrey, 25, at Cloverdale No. 73. Bell said his office received a call at 5:41 p.m. on July 5 saying a victim had been shot.
When officers arrived they found Humphrey had been shot multiple times in the back. Bell said witnesses say the victim was approached from the back, and the shooter opened fire on him. Bell said according to witnesses the victim was shot approximately between eight and 12 times.
Humphrey’s death happened the night before the slaying of Bridget Carmele London Hall, 43, who was fatally shot on July 6 in her home on Vivian Merritt Street.
In March, Bell said Hall’s case was still open, and the BPD was working on it. When asked if the BPD had any suspects or leads, Bell declined to release any further details.

• Donald Hastings, touching or handling a child for lustful purposes.
• Eric Quincy Smith, possession of a firearm by a convicted felony.
• Darrenyun Pendleton, possession of a firearm by a convicted felony.
• Thomas Neil Allred, aggravated domestic violence.
• Phillip G. Smith, simple assault on a law enforcement officer.
• Fred Barrett Shelton, receiving stolen property.
